TEEUP TERMS AND CONDITIONS

Last updated: 17 August 2026

These Terms and Conditions ("Terms") govern your access to and use of the TeeUp mobile application, website and related services.

TeeUp is operated by [FULL LEGAL ENTITY NAME], a company incorporated in the Republic of South Africa with registration number [REGISTRATION NUMBER], trading as TeeUp ("TeeUp", "we", "us" or "our").

Registered / physical address: [ADDRESS] Email: [SUPPORT EMAIL] Telephone: [TELEPHONE NUMBER]

By creating an account, accessing the Platform, making a Booking, or otherwise using TeeUp, you agree to these Terms.

If you do not agree to these Terms, you must not use the Platform.

Nothing in these Terms limits or excludes any right that cannot lawfully be limited or excluded under South African law, including rights under the Consumer Protection Act 68 of 2008 ("CPA").

1. Definitions

In these Terms:

"Booking" means a reservation made through TeeUp for a tee time or related service.

"Booking Fee" means any fee charged by TeeUp for facilitating or providing services relating to a Booking, where applicable.

"Club" means a golf club, golf course, resort, facility or other golf service provider whose services are listed or bookable through TeeUp.

"Club Services" includes tee times, golf rounds, carts, equipment, food, beverages, events and any other services supplied by a Club.

"Golfer" or "User" means a person who accesses or uses the Platform.

"Guest" means a player included in a Booking who may or may not have their own TeeUp account.

"Platform" means the TeeUp mobile applications, websites, APIs and related TeeUp-operated technology and services.

"Platform Services" means the digital services provided by TeeUp, including course discovery, tee-time discovery, booking functionality, payments functionality, social features, invitations, booking management, GPS functionality and related services.

"Course Policies" means the relevant Club's rules, cancellation terms, dress codes, player requirements, operating procedures and other policies disclosed through TeeUp or by the Club.

PART A — USING TEEUP

2. Eligibility

2.1 Account holders

You must be at least 18 years old and legally capable of entering into a binding agreement to create a TeeUp account.

We may introduce functionality allowing minors to use certain services with verified parental or guardian consent. If we do so, additional terms may apply.

2.2 Junior golfers as Guests

A person under 18 may be included in a Booking as a Guest where permitted by the relevant Club.

If you provide information relating to a minor, you confirm that you are:

  • the minor's parent or legal guardian; or
  • otherwise lawfully authorised to provide that information.

You must not provide personal information relating to a child without the authority required by applicable law.

2.3 Accurate information

You must provide accurate, current and complete information when creating an account or making a Booking.

You must update information if it becomes materially inaccurate.

3. Your Account

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • activity carried out through your account;
  • protecting access to your device;
  • notifying us promptly if you believe your account has been compromised; and
  • ensuring that persons using your account are authorised to do so.

You may not sell, transfer or provide another person with permanent access to your account.

TeeUp may require identity, telephone number, email address or other verification where reasonably necessary for fraud prevention, account security or regulatory compliance.

PART B — TEEUP'S ROLE

4. TeeUp is a technology and booking platform

TeeUp provides technology that enables Golfers to discover Clubs, view available tee times, make Bookings and use related services.

Unless the Booking screen expressly states otherwise:

the Club, and not TeeUp, is the supplier of the golf round, tee time, cart and other Club Services.

A Booking may therefore create:

1. a contract between you and TeeUp for the applicable Platform Services; and 2. a separate contract between you and the relevant Club for the Club Services.

TeeUp does not own, operate or control participating golf courses merely because they are listed on the Platform.

Clubs remain responsible for matters within their control, including:

  • the operation and condition of their facilities;
  • tee-time availability;
  • course closures;
  • course rules;
  • staffing;
  • cart availability;
  • dress codes;
  • player eligibility requirements;
  • course safety;
  • the quality and delivery of Club Services; and
  • compliance with laws applicable to their operations.

TeeUp remains responsible for its own obligations as a supplier of Platform Services to the extent required by law.

5. Course information

Club profiles may contain information supplied by Clubs, third-party data providers or other sources.

We take reasonable steps to present information accurately but cannot guarantee that every:

  • price;
  • tee time;
  • facility;
  • course notice;
  • opening time;
  • map;
  • photograph;
  • cart availability indicator;
  • course condition; or
  • other Club-supplied detail

will always be complete or current.

Where information materially affects a Booking, the information displayed during checkout and in the Booking confirmation will apply, subject always to applicable law.

PART C — BOOKINGS

6. Making a Booking

A displayed tee time is not guaranteed until the Booking has been successfully completed and confirmed.

TeeUp or a Club may temporarily place a tee time on hold while payment or Booking processing is completed.

A Booking is confirmed only when the Platform records it as confirmed and, where payment is required, the applicable payment process has been successfully completed or otherwise accepted.

A failed, abandoned, reversed or expired payment may result in the tee time being released.

7. Booking for other players

You may be able to include friends, Guests or other Golfers in a Booking.

Where you do so, you confirm that:

  • you have their permission to provide the information reasonably required to make the Booking;
  • the information you provide is accurate to the best of your knowledge;
  • you will communicate relevant Booking information and Course Policies to them; and
  • where you agree to pay on behalf of other players, you are authorised to do so.

You may not purport to waive another person's statutory rights on their behalf unless you are legally authorised to do so.

Each player remains responsible for complying with the relevant Club's rules while using Club facilities.

8. Club rules

A Club may impose reasonable conditions relating to matters such as:

  • dress code;
  • handicap requirements;
  • maximum or minimum player numbers;
  • cart use;
  • pace of play;
  • check-in time;
  • age restrictions;
  • behaviour;
  • course closures;
  • competition rules; and
  • safety requirements.

Where a Club policy materially affects a Booking, TeeUp will endeavour to make the relevant policy available before or during the Booking process.

You are responsible for reviewing applicable Course Policies before completing the Booking.

PART D — PRICING AND PAYMENTS

9. Prices

The Platform will display the amount payable before you confirm a paid Booking.

The total may include:

  • green fees;
  • player fees;
  • cart fees;
  • Club charges;
  • optional add-ons;
  • promotional discounts;
  • taxes where applicable; and
  • a TeeUp Booking Fee or service fee, where applicable.

Any TeeUp Booking Fee will be separately identified or otherwise clearly disclosed before payment.

We will not add undisclosed mandatory charges after you have confirmed the transaction.

10. Payments

Payments may be processed by third-party payment providers, including Paystack or another approved provider.

By making a payment, you also agree to any payment-provider terms applicable to that transaction.

TeeUp does not require you to provide your full payment-card details directly to TeeUp where those details are collected by the payment provider.

We may receive transaction information such as:

  • payment status;
  • payment reference;
  • amount;
  • payment method type;
  • refund status; and
  • information required for fraud prevention and reconciliation.

The handling of personal information is further explained in our Privacy Policy.

11. Payment failures

A Booking may remain in a payment-pending state for a limited period.

If payment is unsuccessful, you may be able to retry payment.

TeeUp and the Club are not obliged to hold a tee time indefinitely while payment remains incomplete.

If your financial institution appears to have debited you but TeeUp does not show successful payment, contact TeeUp support before making repeated payments.

12. Fraud, reversals and chargebacks

You may not:

  • use payment information without authority;
  • make a fraudulent Booking;
  • knowingly initiate an improper chargeback;
  • use TeeUp to facilitate unlawful transactions; or
  • provide false information relating to a payment dispute.

A legitimate chargeback right is not restricted by these Terms.

Where a payment is reversed, disputed or determined to be fraudulent, TeeUp or the Club may suspend fulfilment of the affected Booking to the extent reasonably necessary and lawful.

PART E — CANCELLATIONS, REFUNDS AND CHANGES

13. Your right to cancel

You may cancel an advance Booking through the Platform where cancellation functionality is available, or through the support process identified by TeeUp.

Your right to cancel is subject to applicable South African consumer law.

A Club may impose a reasonable cancellation charge where permitted by law.

Any cancellation charge must be assessed having regard to relevant circumstances, which may include:

  • the nature of the Booking;
  • how much notice was provided;
  • the likelihood that the tee time can reasonably be resold; and
  • normal practices within the relevant industry.

A Club policy or TeeUp policy does not override any statutory consumer right.

14. Death or hospitalisation

Where the Consumer Protection Act applies, no cancellation fee will be imposed where a person is unable to honour the Booking because of the death or hospitalisation of the person for whom, or for whose benefit, the Booking was made.

TeeUp or the Club may request reasonable supporting information where necessary to verify the circumstances.

15. Cancellation policies shown at checkout

A Club may publish a cancellation schedule or policy through TeeUp.

For example, a Club may differentiate between cancellations made:

  • several days in advance;
  • within 24 or 48 hours of the tee time; or
  • shortly before the tee time.

Any such policy remains subject to applicable consumer law and may not impose a cancellation charge that is unreasonable in the circumstances.

If a displayed policy conflicts with mandatory law, mandatory law prevails.

16. No-shows and late arrivals

If you do not arrive for a confirmed Booking and have not cancelled it, the Club may treat the Booking as a no-show.

A Club may retain some or all of the amount paid only to the extent that doing so is reasonable and lawful in the circumstances.

Late arrival may result in the Club:

  • moving your tee time;
  • shortening the available playing window;
  • pairing or rearranging players; or
  • being unable to accommodate you.

TeeUp does not control operational decisions taken by a Club on the day.

17. Club cancellations and course closures

A Club may occasionally need to cancel or change a Booking because of matters such as:

  • dangerous weather;
  • lightning;
  • flooding;
  • frost;
  • course damage;
  • maintenance;
  • competition requirements;
  • operational problems;
  • safety concerns; or
  • events outside the Club's reasonable control.

Where Club Services that you paid for cannot be supplied, you will be entitled to the refund, rescheduling, credit or other remedy required by applicable law.

A Club or TeeUp may offer a rescheduled tee time or credit as an alternative, but offering an alternative does not remove a refund right where a refund is required by law.

18. Refund processing

Approved refunds will ordinarily be returned through the original payment method where technically possible.

Banks and payment providers may require additional processing time after TeeUp or the Club has initiated a refund.

TeeUp is not responsible for delays caused solely by a bank or payment provider after the refund has been correctly initiated, but we will provide reasonable assistance in tracing a refund.

19. Online cooling-off periods

Certain electronic transactions may carry statutory cooling-off rights.

However, statutory cooling-off rights that would otherwise apply to electronic transactions may not apply to leisure services reserved for a specific date or period.

Golf tee-time Bookings are generally specific-date leisure services.

Nothing in this clause removes any cancellation right that you have under the Consumer Protection Act or other applicable law.

PART F — CARTS AND ADDITIONAL SERVICES

20. Golf carts

Where the Platform allows you to reserve or pay for a golf cart:

  • availability remains subject to Club inventory and operational conditions;
  • the Club determines who may operate a cart;
  • the Club's cart rules apply;
  • the Club may withdraw cart use where weather, course conditions or safety require it; and
  • additional charges may apply if clearly disclosed before Booking.

A cart reservation displayed as confirmed remains subject to extraordinary operational or safety restrictions imposed by the Club.

Where a paid cart cannot be supplied, the appropriate refund or other remedy will be provided as required by law.

PART G — GPS, MAPS AND LOCATION SERVICES

21. Location permission

Some TeeUp features use device location services to provide functionality such as:

  • nearby course discovery;
  • location-based course suggestions;
  • hole detection;
  • position on a hole;
  • distance measurements; and
  • GPS golf features.

You can control location permissions through your device settings.

Disabling location access may prevent certain features from functioning.

Further information about our collection and use of location data is contained in the TeeUp Privacy Policy.

22. Important GPS and mapping notice

IMPORTANT: TEEUP GPS DISTANCES, COURSE MAPS, HOLE POSITIONS AND LOCATION-BASED INFORMATION ARE ESTIMATES AND MUST NOT BE RELIED ON AS SAFETY OR EMERGENCY NAVIGATION INFORMATION.

GPS accuracy can be affected by:

  • your device;
  • satellite availability;
  • buildings;
  • trees;
  • terrain;
  • weather;
  • map-data quality;
  • course changes; and
  • technical errors.

Course layouts may also change after mapping data was collected.

You must remain aware of your physical surroundings and comply with physical course signage, marked hazards, restricted areas and Club instructions.

If TeeUp information conflicts with a physical safety instruction or Club instruction, follow the physical or Club instruction.

Do not operate or interact with a mobile device in a manner that makes operation of a golf cart or other vehicle unsafe.

PART H — GOLF AND PHYSICAL SAFETY

23. Important risk notice

GOLF COURSES AND GOLF ACTIVITIES INVOLVE PHYSICAL RISKS, INCLUDING RISKS ASSOCIATED WITH GOLF BALLS, CLUBS, CARTS, WATER, UNEVEN TERRAIN, WEATHER, LIGHTNING, WILDLIFE, VEGETATION AND OTHER PERSONS USING THE COURSE.

TeeUp is a booking and technology platform and does not supervise your physical participation in golf.

You must:

  • exercise appropriate care;
  • comply with Club safety rules;
  • remain alert to changing conditions;
  • stop play where instructed;
  • obey lightning or evacuation warnings; and
  • use reasonable judgment concerning your own safety.

Nothing in these Terms excludes liability that may not lawfully be excluded.

Where a particular Club requires an additional safety acknowledgement or waiver, that document is between you and the Club unless expressly stated otherwise.

24. No emergency service

TeeUp is not an emergency or rescue service.

Do not rely on TeeUp for emergency communication, medical assistance, weather warnings or rescue services.

In an emergency, contact the Club, local emergency services or another appropriate emergency provider.

PART I — FRIENDS, INVITATIONS AND SOCIAL FEATURES

25. Friend and invitation features

TeeUp may allow Users to:

  • send friend requests;
  • invite players to Bookings;
  • share rounds;
  • create or follow invitation links;
  • join using invitation codes; and
  • block other Users.

You must use these features lawfully and respectfully.

You may not use TeeUp to harass, threaten, stalk, impersonate, discriminate against or abuse another person.

26. Invitation links and codes

Invitation links and codes may permit another person to access information relating to a Booking.

You are responsible for deciding with whom you share an invitation link or code.

You must not intentionally publish private Booking links in circumstances where doing so may expose another person's private information without authority.

TeeUp may invalidate an invitation code or link where necessary for security, privacy, fraud prevention or Booking administration.

27. Blocking

Blocking another User may restrict that person's ability to interact with you through Platform social features.

Blocking a User does not necessarily:

  • cancel an existing Booking;
  • remove a person from a Club's operational tee sheet;
  • cancel a payment; or
  • prevent unavoidable interaction where both persons are independently booked into the same Club facility.

Contact support if a safety or harassment concern requires additional action.

PART J — USER CONTENT

28. Content you provide

You may provide TeeUp with content such as:

  • profile information;
  • profile images;
  • messages;
  • Booking notes;
  • reports;
  • feedback;
  • course-related information; or
  • other material.

You retain ownership of intellectual property that you own in your content.

You grant TeeUp a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process that content only to the extent reasonably necessary to:

  • operate TeeUp;
  • provide the feature for which the content was submitted;
  • secure the Platform;
  • support Users;
  • comply with law; and
  • enforce these Terms.

This licence ends when the relevant content is deleted, except where continued retention is reasonably required by law, for security, dispute resolution, backups or legitimate record-keeping purposes.

29. Prohibited content

You may not upload, submit or distribute content that:

  • is unlawful;
  • infringes intellectual property rights;
  • unlawfully discloses another person's personal information;
  • is fraudulent or deliberately misleading;
  • contains malicious software;
  • contains threats or harassment;
  • promotes unlawful discrimination;
  • facilitates criminal activity; or
  • otherwise materially interferes with the safe operation of TeeUp.

We may remove content where reasonably necessary to enforce these Terms or comply with law.

PART K — ACCEPTABLE USE

30. Prohibited conduct

You may not:

  • access another person's account without permission;
  • scrape or systematically extract TeeUp data without written permission;
  • bypass security or access controls;
  • probe or attack TeeUp systems;
  • introduce malware or malicious code;
  • manipulate Booking availability;
  • make fraudulent or speculative Bookings;
  • create accounts using false identities;
  • interfere with another User's Booking;
  • reverse engineer protected portions of the Platform except where the law expressly permits it;
  • use automated systems in a manner that materially interferes with the Platform;
  • abuse promotional offers;
  • impersonate a Club or TeeUp representative; or
  • use TeeUp for unlawful purposes.

31. Suspension and restriction

We may temporarily restrict or suspend an account where we reasonably believe this is necessary because of:

  • fraud;
  • payment abuse;
  • security compromise;
  • unlawful activity;
  • harassment;
  • material breach of these Terms;
  • repeated deliberate no-shows or Booking abuse;
  • risk to other Users or Clubs; or
  • a legal or regulatory requirement.

Where reasonably possible and appropriate, we will provide notice of a suspension and an opportunity to contact support.

We will not exercise suspension rights in a manner that unlawfully deprives a consumer of rights relating to an existing paid Booking.

PART L — THIRD-PARTY SERVICES

32. Third-party providers

TeeUp relies on third-party services that may include:

  • payment providers;
  • cloud hosting providers;
  • mapping providers;
  • golf course data providers;
  • authentication providers;
  • email or messaging providers;
  • app stores; and
  • analytics or security providers.

Third-party services may be subject to their own terms and privacy policies.

TeeUp remains responsible for its obligations under applicable law and does not use this clause to exclude responsibility where the law places responsibility on TeeUp.

PART M — PRIVACY AND PERSONAL INFORMATION

33. Privacy Policy

Use of TeeUp involves the processing of personal information.

Our separate Privacy Policy explains, among other matters:

  • what information we collect;
  • why we collect it;
  • location-data processing;
  • payment-related information;
  • information shared with Clubs;
  • information concerning Guests;
  • service providers;
  • data retention;
  • international transfers where applicable;
  • security;
  • marketing;
  • your rights; and
  • how to contact our Information Officer.

The Privacy Policy forms part of the rules governing your use of TeeUp but does not reduce any right you have under the Protection of Personal Information Act 4 of 2013 ("POPIA").

PART N — INTELLECTUAL PROPERTY

34. TeeUp intellectual property

Except for User content, Club content and third-party material, TeeUp and its licensors own or have rights to the software, design, branding, databases, graphics, interfaces and other intellectual property making up the Platform.

Subject to these Terms, TeeUp grants you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose.

You acquire no ownership in TeeUp intellectual property by using the Platform.

35. Third-party course and map data

Certain course maps, geographical information and other datasets may be licensed from third-party providers.

Your access to such data is limited to normal use of TeeUp.

You may not extract, reproduce, resell or independently commercialise licensed map or course data unless expressly permitted.

PART O — PLATFORM OPERATION

36. Platform availability

We aim to keep TeeUp available and reliable but cannot guarantee uninterrupted availability.

The Platform may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • infrastructure failures;
  • internet outages;
  • third-party outages;
  • cyber incidents;
  • force majeure events; or
  • other technical issues.

We will take reasonable steps appropriate to the circumstances to restore affected Platform Services.

37. Changes to features

TeeUp may add, improve, replace or discontinue Platform functionality.

We will not materially alter an existing paid Booking merely because a Platform feature changes.

Where a change materially affects an ongoing paid service supplied directly by TeeUp, we will provide the notice or remedy required by applicable law.

PART P — WARRANTIES AND LIABILITY

38. Consumer rights preserved

Nothing in these Terms:

  • excludes a warranty imposed by law where that warranty cannot lawfully be excluded;
  • removes your rights under the CPA, POPIA or other applicable legislation;
  • excludes liability for gross negligence where such exclusion would be unlawful;
  • excludes liability for wilful misconduct where such exclusion would be unlawful; or
  • requires you to waive a right that cannot lawfully be waived.

Any limitation in these Terms applies only to the maximum extent permitted by law.

39. Club-controlled matters

Because Clubs independently operate their golf facilities, TeeUp is not responsible for loss arising solely from a Club's acts or omissions where TeeUp neither caused nor was legally responsible for those acts or omissions.

This may include matters such as:

  • course condition;
  • Club staffing;
  • food or beverage services;
  • on-course supervision;
  • Club-owned cart condition;
  • physical premises;
  • Club employee conduct; or
  • a Club's failure to follow its own operating procedures.

This clause does not apply where applicable law makes TeeUp responsible despite the Club's involvement.

40. Platform information

To the extent permitted by law, TeeUp is not liable merely because:

  • GPS measurements are not exact;
  • a third-party map contains an error;
  • a Club-supplied description becomes outdated;
  • estimated distances differ from physical course markers; or
  • information changes after it was provided to TeeUp,

provided that TeeUp has not acted unlawfully, fraudulently or with a degree of negligence for which liability may not lawfully be excluded.

41. Indirect loss

To the extent permitted by law, TeeUp will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable as a result of TeeUp's breach of an obligation owed to you.

This clause does not limit liability where such limitation is prohibited by law.

PART Q — YOUR RESPONSIBILITY TO TEEUP

42. Liability arising from unlawful use

To the extent permitted by law, you are responsible for loss suffered by TeeUp as a direct result of your:

  • fraud;
  • intentional unlawful conduct;
  • unauthorised use of another person's payment details;
  • malicious attack on the Platform;
  • knowing infringement of third-party intellectual property rights; or
  • knowing unlawful disclosure of another person's personal information.

You will not be required to indemnify TeeUp for loss caused by TeeUp's own unlawful conduct, negligence or breach to the extent that imposing such an obligation would be unlawful or unfair.

PART R — PROMOTIONS AND SPECIALS

43. Promotions

TeeUp or a Club may offer:

  • promotional prices;
  • discount codes;
  • specials;
  • vouchers; or
  • limited offers.

Additional promotional terms may apply.

Any material restriction must be disclosed before you use the offer.

TeeUp may refuse or reverse a promotional discount that was obtained through fraud, technical manipulation or clear abuse, subject to applicable consumer law.

PART S — ACCOUNT TERMINATION

44. Closing your account

You may request closure of your TeeUp account.

Closing an account does not automatically:

  • cancel future Bookings;
  • cancel lawful payment obligations;
  • remove records TeeUp is legally required to retain; or
  • terminate an unresolved refund or dispute.

Where possible, you should cancel or complete outstanding Bookings before closing your account.

Deletion and retention of personal information are governed by our Privacy Policy and applicable law.

45. TeeUp ending access

TeeUp may permanently terminate an account for serious or repeated breaches of these Terms, fraud, unlawful use or material security threats.

Termination does not remove rights or obligations that arose before termination.

Where you have a valid paid Booking, we will take reasonable steps to ensure termination is handled consistently with your statutory rights.

PART T — COMMUNICATIONS

46. Electronic communications

You agree that TeeUp may provide contractual and service-related communications electronically, including through:

  • the Platform;
  • email;
  • SMS;
  • push notification; or
  • another electronic channel associated with your account.

Examples include:

  • Booking confirmations;
  • cancellation notices;
  • payment notices;
  • security alerts;
  • changes to a tee time;
  • course-status notifications; and
  • changes to these Terms.

Marketing communications are subject to separate legal requirements and your applicable communication preferences.

PART U — CHANGES TO THESE TERMS

47. Updating these Terms

We may amend these Terms where reasonably necessary because of:

  • changes to the Platform;
  • new functionality;
  • changes in law;
  • regulatory requirements;
  • security requirements; or
  • changes to our business model.

Where a change is material, we will provide reasonable notice through the Platform or another appropriate electronic channel.

Changes will apply prospectively unless the law requires otherwise.

The terms applicable when you made a confirmed Booking will ordinarily continue to govern that Booking where a later change would materially prejudice your rights.

PART V — COMPLAINTS AND DISPUTES

48. Contact TeeUp first

If you have a problem with:

  • a Booking;
  • payment;
  • refund;
  • Club listing;
  • account;
  • privacy matter; or
  • Platform functionality,

please contact us at:

Email: [SUPPORT EMAIL] Telephone: [SUPPORT NUMBER] Address: [PHYSICAL ADDRESS]

Please include sufficient information for us to investigate the matter.

We will attempt to resolve complaints within a reasonable period.

49. Club complaints

Where a complaint concerns the actual provision of Club Services, TeeUp may refer the matter to the relevant Club and assist with communication.

Referral to a Club does not remove any obligation that TeeUp independently owes you under law.

50. Statutory remedies

Nothing in these Terms prevents you from approaching:

  • the National Consumer Commission;
  • the Information Regulator in relation to personal-information matters;
  • another regulator or ombud with jurisdiction;
  • a competent tribunal; or
  • a court with jurisdiction,

where you are entitled to do so.

PART W — GOVERNING LAW

51. South African law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a court, tribunal, regulator or other body that has jurisdiction under applicable South African law.

Nothing in this clause deprives a consumer of a right to approach a body or court that the law permits the consumer to approach.

PART X — GENERAL

52. Entire agreement

These Terms, the Privacy Policy, information displayed during checkout and any applicable Course Policies constitute the terms relevant to your use of TeeUp and a particular Booking.

A separate agreement may apply to services not covered by these Terms.

Golf Clubs that use TeeUp's administrative or business tools may be subject to a separate Course Partner Agreement.

53. Order of precedence

If documents relating to a Booking conflict, the following order will generally apply:

1. mandatory applicable law; 2. specific terms clearly disclosed and accepted during checkout; 3. applicable Course Policies; 4. these Terms.

A Club policy cannot reduce a statutory consumer right.

54. Severability

If a provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remainder of the Terms will continue to apply.

55. No waiver

If TeeUp does not immediately enforce a provision of these Terms, this does not mean TeeUp permanently waives the right to enforce it.

56. Assignment and business transfers

TeeUp may transfer its rights and obligations under these Terms as part of a bona fide restructuring, merger, acquisition or sale of the TeeUp business, provided that doing so does not unlawfully reduce your rights.

You may not transfer your TeeUp account to another person without our consent.

57. Force majeure

Neither TeeUp nor a Club will be treated as having guaranteed that circumstances beyond reasonable control will never affect a Booking or Platform Service.

Such circumstances may include severe weather, natural disasters, electricity failures, telecommunications failures, civil unrest, government restrictions or comparable events.

This clause does not remove any refund or other consumer remedy that applicable law requires when paid services cannot be supplied.

PART Y — SUPPLIER INFORMATION

58. TeeUp operator

The Platform is operated by:

Legal name: [FULL LEGAL ENTITY NAME] Trading name: TeeUp Legal form: [e.g. Private Company (Pty) Ltd] Registration number: [REGISTRATION NUMBER] Country of registration: Republic of South Africa Physical address: [PHYSICAL ADDRESS] Postal address: [POSTAL ADDRESS, IF DIFFERENT] Email: [EMAIL ADDRESS] Telephone: [TELEPHONE NUMBER] Website: [WEBSITE] Information Officer / privacy contact: [PRIVACY EMAIL]

59. Acceptance

By selecting the checkbox or button indicating that you accept these Terms, creating an account where acceptance is required, or completing a Booking after being presented with these Terms, you acknowledge that:

  • you have been given an opportunity to read these Terms;
  • you understand that they form a binding agreement;
  • important limitations and risk notices have been brought to your attention; and
  • your use of TeeUp remains subject to rights that applicable law does not permit you to waive.

END OF TERMS
